Chhattisgarh RERA Exception Cases

There are certain exceptions wherein developers don’t have to register the real estate projects under ChhattisgarhRERA. These are:

  • The project area does not exceed the 500 sq metres cap placed by ChhattisgarhRERA.

Chhattisgarh RERA Rules:

The penalties by RERA Chattisgarh for non-compliance of its rules is as follows:

1. Chhattisgarh RERA – Interest penalty on project delay:

One of the major rules of Chhattisgarh RERA is that the developer has to pay interest for delay in possession of an apartment, plot or building, as defined in terms of the agreement for sale. The developer has to pay the interest mentioned in terms of sale for every month of delay.

2. Chhattisgarh RERA – Refund in case of non-completion:

If the buyer is unable to complete the project, investors are entitled to receive a complete refund on the amount paid along with interest.

3. Chhattisgarh RERA – Sharing Project Updates:

Developers have to share quarterly updates on the status of all the projects registered under RERA as part of Chhattisgarh RERA rules.

4. Chhattisgarh RERA – Cap on Advance Deposit:

Under RERA rules, builders are not allowed to accept over 10% of the total cost of the property as advance payment without signing an agreement for sale with the party.

5. Chhattisgarh RERA – Escrow Account Rules:

Builders are required to deposit 70% of the funds, collected from the buyers in the promise of delivering the project, in an escrow account. Chhattisgarh RERA makes it mandatory for developers to use the funds only for land purchase and construction purposes.

6. Chhattisgarh RERA – Project Advertisement Rules:

According to rules, developers are required to share all the facilities and amenities mentioned in project advertisements or prospectus with RERA’s official portal.

7. Chhattisgarh RERA – Penalty On Not Registering:

Real estate agents have to pay a penalty of Rs 100,000 per day for not registering with the CG RERA. The upper limit on the penalty is set at 5% of the cost of the project sold without a registration number from the authority.

  4. During the marketing of the project, it is mandatory for the builder to mention the carpet area of the project and not just the super-built-up area.
